Raising A Personal Grievance

The date today is 07 October, 2025. You may be eligible to raise a personal grievance if you were dismissed, disadvantaged, or discriminated against, and the event(s) you are complaining about occurred on or after 13 July, 2025.

We might also be able to help you claim wage arrears between 07 October, 2019 and now.

Representing You At Disciplinary or Performance Meetings

An advocate from ERNZ is able to represent you (with your permission!) at any meeting with your employer where you feel you need support. As your representative, your advocate is not a silent observer - our role is to speak up for you and ensure that you are treated fairly during the process. There will always be times when your employer wants to hear from you, not from us, so always be prepared to answer questions if asked. It is sometimes helpful if you are really anxious that we prepare written responses to any allegations you may be facing so that there is a record of your formal response on file for you to refer to. We will prepare this for you (with your help) before we meet with your employer.

Assisting You At Mediation

Mediation can be overwhelming if you've never experienced it before. If you've already sent in a personal grievance to your employer, and they have filed for mediation with MBIE, an advocate from ERNZ can represent you at the mediation meeting. That means we can present your case to the other party (your employer), and help you to seek an appropriate settlement of your grievance. The settlement could be an agreement to change something about your employment, or financial compensation if you have been dismissed or forced to resign because of some repudiatory breach of your terms and conditions of employment by your employer.

Representing You At The Employment Relations Authority

ERNZ advocates can also help you to put together your case to file your complaint to the Employment Relations Authority (known as 'ERA'), and help you to find a good lawyer to represent you there. We have a couple of lawyers we regularly work with who are really experienced in presenting cases to the ERA. Having us in the background from the early stages of your case allows us to ensure that all of the information you need to ready to go, so your legal fees don't get out of hand. If you win your case, the ERA will automatically award costs against the other party, so you can recoup your legal fees - $4500.00 for the first day and $3500.00 per day after that.
